Almost twelve years after the partial privatization of the Berlin Water Works by the CDU-SPD Senate, Eberhard Diepgen, the citizens of the capital's legal requirement to disclose the secret treaties signed in 1999 have won. 1999 hatten die Konzerne RWE und Veolia 49,9 Prozent der Anteile an den Berliner Wasserbetrieben erworben. Das Land gab den privaten Teilhabern vertraglich eine Renditegarantie, die vom Landesverfassungsgericht für unwirksam erklärt, faktisch aber erfüllt wurde. Seit der Privatisierung stieg der Wasserpreis in Berlin um rund 35 Prozent. Auch die seit 2002 regierende SPD-Linke-Koalition hatte in der Vergangenheit Anträge auf Akteneinsicht in die Privatisierungsverträge mit Verweis auf Betriebs- und Geschäftsgeheimnisse der privaten Investoren, aber auch des Landes Berlin selbst abgelehnt.
SPD und Linke hatten die Bürger aufgerufen, der Abstimmung fernzubleiben. Ihrer View, were already in early November after it became clear that it would come to a referendum, revealed all agreements agreed upon by the state and the private shareholders.
